This TeachTown Facilitator Agreement (the "Facilitator Agreement") is between you and Jigsaw Learning, LLC dba TeachTown (" TeachTown," " we," " our," or " us"), and supplements the TeachTown Terms of Service for Users who request to use the Service as a facilitator for one or more specific Students ("Facilitator"). Terms used but not defined herein have the meaning set out in our Terms of Service.

By signing an order form that incorporates this Facilitator Agreement by reference, by clicking a button or checking a box marked "I Accept" (or something similar) or by otherwise accessing or using the Service as a Facilitator, you signify that you have read, understood and agree to be bound by this Facilitator Agreement. In addition, you acknowledge that you have read and understood our Privacy Notice. TeachTown reserves the right to modify this Facilitator Agreement and will provide notice of any material changes as described in our Terms of Service.

As a Facilitator, you will have access to, contribute, extract, or receive data about one or more Students that is confidential and/or protected by law. Account access via your login and password should be limited to only you. You expressly waive and release TeachTown from and against any and all claims, actions, damages and liability arising in connection with TeachTown's or other Facilitators' access to, receipt of or use of such data. You acknowledge and agree that your obligations as a Facilitator are based on your relationship to the Student and applicable law.

If you are the Student's legal guardian, you hereby consent to the Student's enrollment in the Service and acknowledge that the Student's data will be collected, used and disclosed in accordance with our Privacy Notice. For example, information about the Student may be shared with TeachTown and other Facilitators, such as through the issuance of reports about Student's progress.

If you are someone other than the Student's legal guardian, you represent and warrant that you are signing in as the sole account and login owner for your designated system access and have received all necessary authorization to use the Service as a Facilitator for the Student, to use the Student's data, and to disclose that data to TeachTown and other Facilitators. You also agree to maintain the confidentiality of all information about Student disclosed or received through the Service. You agree not to use, transmit, or otherwise disclose that information in any manner not authorized by the Student's legal guardian or otherwise under applicable law.

In addition, you acknowledge that some of Student data may be subject to student data privacy laws such as the Family Educational Rights and Privacy Act, 20 U.S.C. Sec. 1232(g)) and the regulations thereunder (34 CFR Part 99) ("FERPA"), and agree to comply with any applicable laws and regulations in your role as a Facilitator.
